1. General

The website poljsakova-brajda.si is operated by Poljšakova Brajda, Šmarje 28a, 5295 Branik, Slovenia (the “provider”). By visiting the website, making an enquiry or booking, you agree to these terms and conditions.

2. Age restriction

Content concerning alcoholic beverages is intended for people aged over 18 years. Selling or serving alcoholic beverages to minors is prohibited in Slovenia under the Act Restricting the Use of Alcohol (ZOPA). Drink responsibly.

3. Booking tastings and visits

We confirm bookings in writing (by email) or by phone. Please notify us of any cancellation at least 24 hours before your booking. For groups larger than 10 people, we reserve the right to require advance confirmation and a deposit.

Tasting prices are listed on the Visit page and include VAT. Payment is normally made during the visit (in cash), or by arrangement.

4. Wine orders

We accept orders by email or phone. An order is agreed when the provider confirms it in writing. Delivery takes place within the period agreed upon confirmation. Because wine is a food product with limited vintage availability, a particular wine may be unavailable; in that case, we will inform you and refund any payment.

5. Right of withdrawal (consumers)

Under the Consumer Protection Act (ZVPot-1), consumers have the right, within 14 days of receiving a shipment, to notify the provider that they are withdrawing from the contract without giving a reason. Returns must be sent to the provider's address; return shipping costs are paid by the buyer. We refund the purchase price within 14 days of receiving the product.

Under ZVPot-1, there is no right of withdrawal for goods that have been opened and are unsuitable for return for health or hygiene reasons (such as opened bottles).

6. Complaints and product defects

Please inform us of any defects (such as a damaged shipment or a corked bottle) within a reasonable time after receipt. The buyer is entitled to a replacement or refund in accordance with applicable law.

7. Prices and VAT

All prices are in euros (EUR) and include VAT unless expressly stated otherwise. We reserve the right to change prices; orders already confirmed retain the prices agreed at confirmation.

8. Intellectual property

All website content (text, photographs, logo and design) is the copyrighted work of the provider or respective rights holders. It may not be copied, distributed or publicly displayed for commercial purposes without written permission.

9. Limitation of liability

The website content is provided for information. The provider is not liable for damage arising from incorrect information or temporary website unavailability, except to the extent required by mandatory law.

10. Out-of-court dispute resolution

The provider does not recognise any out-of-court consumer dispute resolution body as competent to resolve disputes. Consumers may use the EU Online Dispute Resolution platform for disputes concerning online purchases: ec.europa.eu/consumers/odr.

11. Applicable law and jurisdiction

These terms are interpreted and implemented under Slovenian law. The court with subject-matter jurisdiction in Nova Gorica has jurisdiction over disputes.
